Delinquent Tax Bidder Registration


Properties that are being auctioned at the Orangeburg County Tax Sale have not been examined, searched, or reviewed by an attorney. Each property being sold without any warranty or assurance that a purchaser will receive a good title to the property, receive all of the interest in the property, or that the property is free of liens. A purchaser assumes all of the risks as to the condition of the title to and liens against the property sold. Therefore, the County recommends, if you are a successful bidder that prior to taking any action regarding the property you purchase at this auction, you have a title examination performed to determine what interest, if any, you may have received as successful bidder and determine whether the property is subject to any liens. In accordance to state statues that govern Delinquent Tax Sales (specifically including SC Code Section 12-51-40 through 170). The bid amount shall be paid in full by cash, cashier’s check, or money order on the date of sale to the Delinquent Tax Office. Failure to present payment of the bid the day of sale will result in a $500.00 fine.


When the last owner of record of a parcel listed in title documents with the Orangeburg County Register of Deeds Office is or is believed to be deceased, the parcel is referred to as “Heirs Property.” Heirs Property, as a general matter and within the context of the delinquent tax sale process, is subject to additional legal requirements that do not apply to non-Heirs Property. Due to the complexity of the additional legal requirements, a delinquent tax title to Heirs Property is highly likely to be voided in a judicial challenge. Any parcel in the delinquent tax sale auction may be Heirs Property. As a result, if you bid, you may be bidding on Heirs Property. By the act of bidding at the delinquent tax sale auction, you agree to limit your remedies against the County arising from the sale of Heirs Property to solely the following remedy: if you deliver to the Delinquent Tax Collector BEFORE the issuance of a tax title on the Heirs Property a written request that the sale of Heirs Property be voided by the Delinquent Tax Collector, the Delinquent Tax Collector will void the sale and refund the amount of the bid to the successful bidder. You hereby acknowledge that you waive any and all other remedies against the County arising from the sale of Heirs Property.
